Details: Aziz Khan is the son of Dr. Abdul Khan and Rabia Khan He was born on November 13, 2010. It was a day that changed Abdul's life. Abdul's sister, Rubina Khan, and the rest of their family were at the hospital that day. She felt that Aziz was the greatest blessing to their family. He brought joy to their house, and Abdul loved spending time with him.
Rabia was born in Columbus, Georgia. Her family was originally from India and Pakistan. Abdul's mother introduced him to Rabia while they were in school in Alabama. He describes Rabia's personality as strong. She makes it a point to know and demand what she wants. Since he also has a strong personality, they were attracted to each other.
A few years later, Abdul and Rabia married. When Aziz was born, they lived with Abdul's parents in New Orleans, Louisiana. But Rabia had a hard time getting along with them. It became clear to Abdul that they could not stay with his parents. So, they moved out and found their own place in New Orleans.
Abdul is a pulmonologist and works in an intensive care unit. Rabia initially worked at the same hospital as him. However, after a short period of time, she quit. She then worked at a local cancer agency. Then, she left that job as well. According to Abdul, she always found a reason to change jobs, such as disliking a coworker or boss.
Rubina describes Rabia as very guarded. She felt she never really knew who Rabia was. As Aziz grew older, Abdul and Rabia started having problems. They fought almost daily, sometimes in front of Aziz. In April 2014, they decided to separate. She then asked Abdul if she could move to Atlanta, Georgia, to be with her family.
Abdul agreed with Rabia's plan because he believed her family could help her care for Aziz. He also thought that she still wanted to work on their marriage. They agreed to split custody of Aziz, having him go between New Orleans and Atlanta every other weekend. Abdul says it was hard, but he thought it was only temporary.
Several months later, Rabia served Abdul with divorce papers. He and his family were shocked. He says everything changed after that. Rabia would put up hindrances and roadblocks, trying to stop him from seeing Aziz. She would schedule soccer games during Abdul's weekends. She would make up excuses, claiming that Aziz was sick. She would do anything in her power to prevent Aziz from seeing Abdul.
During that time, Rabia met with lawyers and learned about custody. She tried to figure out what she needed to do to keep Aziz in Atlanta. Abdul claims that she wanted Aziz to have nothing to do with his life in New Orleans. After filing for divorce, she blocked Abdul from seeing Aziz. He had to go to court and serve her with papers, informing her that he had the right to see Aziz.
In 2015, the divorce was finalized. But Rabia still kept Aziz from Abdul. That led him to push for a custody evaluation. He wanted to have the right to spend as much time with Aziz as possible. About a year later, the custody evaluators recommended that Abdul get primary custody of Aziz because they felt that Rabia was not allowing Abdul to spend his due time and be a good father for Aziz.
According to Rubina, when Rabia learned that Abdul was going to be awarded primary custody, she went to the courts and made horrific, baseless abuse allegations against him and his family. He claims that she did this to delay the court's evaluation. He says the case soon turned into a "whirlwind", where several lawyers became involved and a year-and-a-half-long investigation occurred.
What made the situation so hard for Abdul was that he was not allowed to see Aziz, who remained with Rabia in Atlanta. As the court proceedings progressed, Abdul and his family learned that Rabia was in a relationship with Elliot Bourgeois, a friend from college. During the time that she and Abdul had marital problems, she often talked with Elliot on the phone.
According to Rubina, Elliot started coming to court with Rabia. Abdul and his family soon learned that Rabia and Elliot were married. Over time, Rabia fired at least three of her lawyers. Then, she and Elliot decided to represent themselves in court. According to Abdul, the judges started seeing through Rabia and Elliot's lies and manipulation.
After Rabia learned that her allegations would probably not be prosecuted, Abdul felt there was a strong possibility that she would flee with Aziz. In October 2017, he hired private investigator J.T. Summers. Summers had his team set up surveillance in the apartment complex where Aziz, Rabia, and Elliot lived. From October 19 to October 23, they put Rabia and Elliot under surveillance for ninety-six hours straight.
The team followed Rabia and Elliot everywhere, including the grocery store, Aziz's school, and Elliot's work. But they did not find anything that suggested that Rabia and Elliot were planning to flee with Aziz. Everything seemed normal. Abdul then decided to have Summers halt the surveillance.
Finally, after eighteen months of thorough investigation, the Atlanta D.A. determined that Rabia’s accusations were false. Abdul was going to get full custody of Aziz. They were to meet on November 28, 2017, in an Atlanta courtroom, where the restrictions would be lifted. Abdul was joyful because he was finally going to see Aziz again.
On November 28, Abdul arrived at the courtroom and waited for the custody hearing to start. The judge showed up, but Rabia did not. Rubina says there was a momentary panic among their family. But they thought it was "Rabia just being Rabia". They believed she would throw something else at them to prolong the case. They waited for several hours, thinking and hoping there was a delay. But Rabia and Aziz never showed up.
Worried, Abdul called Aziz's school, only to learn that they had not seen him in a week. He did not come to school the week of Thanksgiving. They last saw him on November 17, the Friday before Thanksgiving. Abdul called Rabia's family but did not get any response. Finally, he realized that Rabia had kidnapped Aziz.
Rubina was devastated and confused. It did not seem real to her. Abdul was terrified. He felt like someone had removed his heart. For him, the nights were the toughest because it was quiet and he was alone with his thoughts. He thought about his life with Aziz.
Abdul remembers the last time he saw Aziz. It was a seemingly normal weekend in March 2016. They had fun and took a lot of pictures. At the end of each visit, Aziz would ask, "Baba, how many days before I see you again?" On this visit, Abdul told him, "Five more days". Abdul then put him in Rabia’s car, and they drove off. But Abdul never saw Aziz again.
Rubina had previously thought that Rabia was crazy and vindictive. But she never thought Rabia was capable of abducting Aziz. Abdul hired private investigators throughout the country to search for Aziz. Everyone told him that he needed to get national law enforcement involved. However, there needed to be a felony warrant for Rabia. Initially, there was a disagreement between the Atlanta and New Orleans police over who should handle the case.
Finally, after two years, on January 2, 2020, a Louisiana court issued a felony kidnapping warrant against Rabia for Aziz's abduction. Shortly afterward, the U.S. Marshals joined the investigation. Unfortunately, this occurred more than two years after Aziz's disappearance. Deputy U.S. Marshal Brian Fair says they started "way behind".
The U.S. Marshals conducted interviews in several states. They went to Duluth, Georgia, and attempted to interview Rabia's parents. However, her parents were evasive during questioning. They did not appear to be concerned about Aziz, Rabia, or Elliot's whereabouts. Instead, they referred everything to their attorney.
After talking to the U.S. Marshals, Abdul learned that Rabia and Elliot had planned the abduction in advance. He says it was cold and calculated. They had taken Aziz out of school on November 17, ten days before the hearing. That same day, they sold their cars to CarMax in Atlanta. Elliot quit his job. They shut down their cell phones, closed their bank accounts, closed all their social media accounts, abandoned their apartment, and disappeared.
Deputy Fair says Rabia and Elliot could find new jobs if they assumed new identities. They might establish new lines of credit and create a whole new lifestyle. It is also possible that friends or family members are financing them.
Abdul feels that he has done everything he can think of to find Aziz, Rabia, and Elliot. But years later, he has yet to find any trace of them. He says that makes this so hard. Rubina says they will never stop searching for Aziz. They will not rest until he is returned to them. Abdul says that Aziz is his whole world, and one day, he will find him.
Abdul says that time stopped when Aziz disappeared. So, to him, it is like Aziz left yesterday. He thinks about Aziz every day. And he does things every day to try to find him. He plans to keep fighting until he sees him again. He says, "It is time for Aziz to come home."
